Lemon New Tab Terms of Service

These Terms of Service (“Terms”) apply to the browser extension Lemon New Tab, its distribution channels, and its related public source code repository.

By installing, accessing, using, copying, or distributing the extension, you acknowledge that you have read, understood, and agreed to be bound by these Terms and the related Privacy Policy. If you do not agree, do not install or use the extension.

1. Service Description

Lemon New Tab is a local-first browser new tab extension that provides page customization, shortcuts, bookmark display, frequently visited sites display, search, wallpapers, poetry/quote display, and related features. To support site display features, the extension may also locally read or process page titles, page URLs / hostnames, and favicon information from tabs you visit.

Some features depend on browser platform capabilities or third-party services, including without limitation search suggestions, Bing wallpapers, Jinrishici, Hitokoto, third-party favicon services, browser sync capabilities, and online resources configured by you. Those third-party services are not controlled by the developer and do not constitute services independently guaranteed by the developer under these Terms.

2. Eligibility and Acceptance

You represent and warrant that:

  • you have the legal capacity required to enter into and comply with these Terms under applicable law;
  • if you are a minor under the laws of your jurisdiction, you are using the extension under the guidance or with the consent of a parent or guardian;
  • you will use the extension only in a lawful and proper manner consistent with these Terms.

3. License and Scope of Use

Subject to your compliance with these Terms, the developer grants you a non-exclusive, revocable, non-transferable, non-sublicensable license to install and use the extension for personal, educational, testing, or other lawful purposes.

The source code is generally made available under the open-source license included in the repository. However, these Terms govern your use of the extension service, distributed builds, and related functionality, and do not replace the text of the applicable open-source license. If these Terms conflict with the open-source license regarding copying, modifying, redistributing, or licensing of source code, the applicable open-source license will control within its own scope.

4. Your Responsibilities

You agree not to:

  • use the extension in violation of applicable law, regulation, regulatory requirements, or third-party platform rules;
  • use the extension to commit infringement, fraud, harassment, malicious code distribution, security circumvention, or other unlawful conduct;
  • interfere with, disrupt, overload, or bypass the normal operation of browser platforms, third-party services, or extension functionality;
  • call third-party APIs in an automated, excessive, abnormal, or large-scale manner beyond their reasonable use limits;
  • use the extension to access, collect, store, or distribute content that you do not have the right to handle;
  • remove, obscure, or alter copyright notices, trademarks, attribution notices, or disclaimer language.

5. Third-Party Services and External Content

The extension may connect to or display third-party services, third-party content, and external links, including without limitation:

  • the Jinrishici API;
  • the Hitokoto API;
  • Bing wallpapers and Bing search suggestions;
  • Baidu or Google search suggestions;
  • third-party favicon services;
  • online images, videos, APIs, or other network resources configured by you;
  • browser vendor sync, distribution, diagnostic, or app store services.

The developer does not own, control, or guarantee the availability, stability, accuracy, security, legality, continuity, or compliance of such third-party services. Your access to and use of such services may also be subject to their own terms, privacy policies, and other rules.

6. Default Online Features and User Choice

You understand and agree that some online features are enabled by default or available by default, such as search suggestions, Jinrishici content, and third-party favicon lookup, while other online features require your own activation or configuration, such as online wallpapers, custom media URLs, or browser sync. You also understand that, to display shortcuts, frequently visited sites, or related site cards, the extension may locally access tab titles, page URLs / hostnames, and favicon information.

You may decide whether to continue using such online features through extension settings, browser permission settings, network blocking rules, or by uninstalling the extension. Disabling or blocking them may affect feature availability or user experience.

7. Data and Privacy

Your use of the extension is also governed by the Privacy Policy. If these Terms and the Privacy Policy differ in interpretation regarding data processing, lawful bases, user rights, or cross-border transfers, they should be interpreted consistently where possible; if a conflict remains, the Privacy Policy will control for data protection matters.

8. Intellectual Property

Except as otherwise provided by the applicable open-source license, all rights in the extension name, branding, interface design, documentation, release materials, and other legally protected elements remain reserved by the developer or the relevant rights holder.

These Terms do not transfer to you any trademark rights, trade names, domain names, interface design rights, or any other rights not expressly granted.

9. Open-Source License

The repository currently includes the MIT License. Use, copying, modification, and redistribution of source code, documentation, and other covered materials must comply with the applicable license text.

For clarity:

  • the open-source license mainly governs your rights to copy, modify, and redistribute code and related materials;
  • these Terms of Service mainly govern your access to and use of the extension build, release version, online features, and related service behavior.

10. Disclaimer

To the maximum extent permitted by applicable law:

  1. the extension and related content are provided on an “as is” and “as available” basis;
  2. the developer does not guarantee uninterrupted operation, error-free performance, or compatibility with all browser versions or third-party services;
  3. the developer does not guarantee that any third-party API, online resource, search result, wallpaper, poem, quote, or site icon will always be available, accurate, complete, or secure;
  4. the developer does not guarantee that the extension is fit for your particular purpose or that data loss, configuration conflicts, third-party restrictions, API changes, regional blocking, or compatibility issues will not occur;
  5. you are responsible for backing up important configuration, files, and other data, and for deciding whether to enable online features.

11. Limitation of Liability

To the maximum extent permitted by applicable law, the developer will not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising out of or related to:

  • your use of or inability to use the extension;
  • any unavailability, modification, rate limiting, suspension, redirection, error, or shutdown of third-party services;
  • issues caused by browsers, operating systems, network conditions, regional restrictions, app store policies, or sync infrastructure;
  • data loss, configuration corruption, business interruption, device issues, lost profits, or lost opportunities;
  • unauthorized access, malware, attacks, user misconfiguration, or third-party causes.

If applicable law does not allow certain exclusions or limitations, the above limitations apply only to the maximum extent permitted by law.

12. Changes, Suspension, and Termination

The developer may, without prior notice and at any time:

  • modify, limit, suspend, remove, or terminate all or part of the extension functionality;
  • change supported browser versions, feature scope, default settings, third-party dependencies, or distribution channels;
  • update these Terms, the Privacy Policy, or other related notices.

Your continued use of the extension after an update will generally be treated as acceptance of the updated Terms.

13. Violations

If the developer reasonably believes that you have violated these Terms, applicable law, or third-party platform rules, the developer may take measures within the developer’s actual control, including without limitation:

  • issuing warnings or requesting that you stop the relevant conduct;
  • removing, restricting, or adjusting relevant functionality;
  • cooperating with app stores, browser platforms, or relevant third parties;
  • preserving or disclosing information where legally required or reasonably necessary.

14. Governing Law and Disputes

These Terms will be governed by the laws applicable through the developer’s jurisdiction and any mandatory conflict-of-law rules, provided that mandatory consumer protection, privacy, or other laws in your own jurisdiction will prevail where they apply and require a higher standard.

15. Severability

If any provision of these Terms is held invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect to the extent permitted by law.

16. Entire Agreement

To the extent applicable, these Terms, the Privacy Policy, the open-source license text, and any applicable distribution channel requirements constitute the entire agreement between you and the developer regarding use of the extension.
